VILLAGE OF ELIZABETH
ORDINANCE NO. 06-17G
UTILITY DEPOSITS AND TAP FEES FOR UTILITY CUSTOMERS OF THE VILLAGE OF ELIZABETH AND OTHER RELATED MATTERS
BE IT ORDAINED, by the Board of Aldermen of the Village of Elizabeth who in regular session convened, and elected to amend Ordinance 06-17F to increase and/or provide for water, sewer and gas deposit(s) and/or connection fee(s) for utility customers of the Village of Elizabeth and to clarify the provisions of Ordinance 06-17F. Said amended ordinance to become Ordinance 06-17G and is hereby enacted to read as follows:
SECTION 1: Water, sewer and gas deposits and/or connection fees, which are set forth below, are due prior to the connection of utility services unless the Mayor, at his/her discretion, approves a written request for the deposit(s) and/or connection fee(s) to be deferred to a later date.
DEPOSITS AND CONNECTION FEES
Residential Owner:
•Water Deposit: $200.00 plus $25.00 Connection Fee = $225.00
•Gas Deposit: $225.00 plus $25.00 Connection Fee = $250.00
•Water and Gas Deposit: $425.00 plus $50.00 Connection Fee =$475.00
Residential Rental:
•Water Deposit: $250.00 plus $25.00 Connection Fee = $275.00
•Gas Deposit: $275.00 plus $25.00 Connection Fee = $300.00
•Water and Gas Deposit: $525.00 plus $50.00 Connection Fee = $575.00
Commercial Owner:
•Water Deposit: $225.00 plus $25.00 Connection Fee = $250.00
•Gas Deposit: $250.00 plus $25.00 Connection Fee = $275.00
•Water and Gas Deposit: $475.00 plus $50.00 Connection Fee = $525.00
SECTION 2: Water, sewer and gas tap fee(s), which are set forth below, are due prior to the connection of utility services unless the Mayor, at his/her discretion, approves a written request for the tap fee(s) to be deferred to a later date. The tap fee(s) set forth below are for flat ground installations only. In the event that large ditches, road bores, excess flow valves, and any other non-flat ground installations result in additional expenditures by the Village of Elizabeth, these additional costs will be added to the tap fee(s) set forth below.

Residential Owner:
•Sewer Tap: $375.00
•Water Tap: (3/4” Meter): $175.00
•Gas Tap: $250.00
Commercial Owner:
•Sewer Tap: $475.00
•Water Tap: (1” Meter): $350.00
•Water Tap: (2” Meter or Larger): $850.00
•Gas Tap: $300.00
SECTION 3: In the event that utility services are disconnected due to non-payment, the utility customer must bring his/her utility account current within thirty (30) calendar days after the 10th day of the month in which the utility services were disconnected. In the event that the utility customer does not bring his/her utility account current within the thirty (30) day deadline set forth above, the Village of Elizabeth will close and final bill the utility account by applying the utility customer’s deposit that is on file. The utility customer will be responsible for any balance still due and owing after the customer’s deposit has been applied to his/her account.
SECTION 4: In the event that an existing utility account is closed, a utility customer shall pay the applicable utility deposit(s) and/or connection fee(s) set forth above in Section 2 for said utility account to be re-opened.
SECTION 5: Should a utility customer desire to install a natural gas generator at his/her residence and/or commercial structure, said customer must obtain a permit from the Elizabeth Town Hall prior to the installation of the natural gas generator. Permits for the installation of a natural gas generator will be $25.00. In the event that the installation of the natural gas generator results in the Village of Elizabeth incurring expenditures, these additional costs will be added to the $25.00 permit fee set forth above.
SECTION 6: If any provision of this ordinance is determined to be invalid or contrary to the laws of the State of Louisiana, then it shall not invalidate the entirety of this ordinance but only that provision found to be not in compliance with the laws of the State of Louisiana. Furthermore, any other ordinance and/or provisions found to be in conflict with the provisions of this ordinance herein are hereby repealed.
SECTION 7: The amendment herein shall become effective on February 11, 2025.
THIS ORDINANCE was introduced on the 13th day of January, 2025. After Public Hearing having been held on February 10, 2025, title having been read and ordinance considered, on motion by Councilwoman Stacy Weldon and seconded by Councilman Ken Kelly to adopt said Ordinance 06-17G.

Bid for
Painting Town Hall
The Village of Elizabeth located at 230 Poplar Street is accepting bids for painting the Elizabeth Town Hall. It is a 2 story building with lots of windows on both floors. The job requires all prep work prior to painting the building and may require caulking in some areas. Please call the Town Hall office at 318-634-5100 for an appointment to view the building prior to bidding. A detailed bid including itemized prep work, materials and labor will be accepted. All bids must be marked with name, phone number and labeled as “Elizabeth Town Hall Paint Bid”. The bids will be accepted through Friday, March 28, 2025 at 12:00noon. A decision will be decided on Monday, April 1, 2025.

NOTICE OF SPECIAL ELECTION
Pursuant to the provisions of a resolution adopted by the Mayor and Board of Aldermen of the Village of Elizabeth, State of Louisiana (the “Governing Authority”), acting as the governing authority of the Village of Elizabeth, State of Louisiana (the “Village”), on February 10, 2025, NOTICE IS HEREBY GIVEN that a special election will be held within the Village on SATURDAY, MAY 3, 2025, and that at the said election there will be submitted to all registered voters in the Village qualified and entitled to vote at the said election under the Constitution and Laws of the State of Louisiana and the Constitution of the United States, the following proposition, to-wit:
PROPOSITION
(SALES TAX)
Shall the Village of Elizabeth, Louisiana (the “Village”), be authorized to levy and collect a 1% sales and use tax (the “Tax”) in accordance with Louisiana law (an estimated $78,000 reasonably expected at this time to be collected from the levy of the Tax for an entire year), in perpetuity, beginning July 1, 2025, with the proceeds of the Tax (after paying reasonable and necessary costs and expenses of collecting and administering the Tax), to be dedicated and used for the purposes of providing funds for constructing, acquiring, extending, improving, operating, and maintaining sewerage and waterworks facilities, roads and bridges, drainage facilities, and public buildings, including the necessary land, equipment and furnishings therefor, supporting public safety in the Village, and for any other lawful purpose of the Village?
The said special election shall be held at the polling place for the following precinct, which poll will open at seven o’clock (7:00) a.m. and close at eight o’clock (8:00) p.m., in accordance with the provisions of La. R.S. 18:541, to-wit:

The polling place for the precinct set forth above is hereby designated as the polling place at which to hold the said election, and the Commissioner-in-Charge and Commissioners, respectively, shall be those persons designated according to law.
The estimated cost of this election as determined by the Secretary of State based upon the provisions of Chapter 8-A of Title 18 and actual costs of similar elections is $8,100.
The said special election will be held in accordance with the applicable provisions of Chapter 5 and Chapter 6-A of Title 18 of the Louisiana Revised Statutes of 1950, as amended, and other constitutional and statutory authority, and the officers appointed to hold the said election, as provided in this Notice of Special Election, or such substitutes therefor as may be selected and designated in accordance with La. R.S. 18:1287, will make due returns thereof to said Governing Authority, and NOTICE IS HEREBY FURTHER GIVEN that the Governing Authority will meet at its regular meeting place, the Village Hall, 230 Poplar Street, Elizabeth, Louisiana, on MONDAY, MAY 12, 2025, at 6:30 P.M., and shall then and there in open and public session proceed to examine and canvass the returns and declare the result of the said special election. All registered voters of the Village are entitled to vote at said special election and voting machines will be used.

AN ORDINANCE PROVIDING FOR UTILITY RATES FOR UTILITIES PROVIDED BY THE VILLAGE OF ELIZABETH and INCREASES
BE IT ORDAINED, by the Mayor and the Board of Aldermen of the Village of Elizabeth, Louisiana, on August 12, 2024, that the following Section 6 amends to allow an increase in the fixed and variable water rates to become effective September 1, 2024.
BE IT ORDAINED, by the mayor and the Board of Aldermen of the Village of Elizabeth, Louisiana, on March 8, 2024, that the following Ordinance Number 14-18H amended Section 3 and Section 4 effective April 9, 2024 and is hereby enacted to read as follows:
Section 1
BE IT ORDAINED, by the Council of the Village of Elizabeth, Louisiana, in a regular session convened, that the Council hereby amends Ordinance 14-18G to become Ordinance 14-18H of the Village Code which amends the method of increase for water and sewer rates in Section 3 and Section 4 for the Village of Elizabeth’s sewer customers.
Section 2
BE IT FURTHER ORDAINED that the Fixed water and sewer rates of the Village of Elizabeth’s water system were increased effective March 1, 2022 as shown on the previous rate charts adopted the 3rd day of February, 2022.
Section 3
BE IT FURTHER ORDAINED that the Variable rates in the attached rate charts shall adjust every year beginning January 2025 billing cycle. The rates will be increased at a minimum of 3% each year in January to become effective April 9, 2024. Rates to be increased to an amount over 3% if publication of the CPI for All Urban Consumers (CPI-U): U.S.. city average as published by the Bureau of Labor Statistics is larger than 3%. In the event that the CPI is larger than 3%, the rate will be increased to correspond to the CPI rate.and adjusting thereafter the first billing cycle after publication of the CPI for All Urban Consumers (CPI-U): U.S. city average as published by the Bureau of Labor Statistics.
Section 4
BE IT FURTHER ORDAINED that the Fixed rates in the attached rate charts shall adjust every year beginning January 2025 billing cycle. Section 5
In addition to the costs outlined in the foregoing sections, all customers shall be charged the following re-read fees, should they request a re-read of their meter:
In Town Customers: $15.00
Out of Town Customers: $25.00
A customer will not be charged a re-read fee if an error is discovered on the part of the Village of Elizabeth. An error occurs when a customer’s meter is read in a mistaken amount upon its first reading in any given month.
If a customer requests for Water Utility Services to be reconnected or disconnected outside of normal business hours, they will be charged a fee of:
In Town Customers: $25.00
Out of Town Customers: $30.00
Section 6
BE IT FURTHER ORDAINED that this ordinance amendment adopted on August 12, 2024 increases the fixed and variable water rates and shall become effective September 1, 2024. See attached chart.
Section 7
BE IT FURTHER ORDAINED that if any provision or item of this ordinance or the application thereof is held invalid, such invalidity shall not affect other provisions, items, or applications of this ordinance which can be given effect without the invalid provisions, items, or applications, and to this end the provisions of this ordinance are hereby declared severable.
Section 8
BE IT FURTHER ORDAINED that all ordinances or parts of ordinances in conflict herewith are hereby repealed.
Ordinance amendment to Section 6 introduced on the 8th day of July, 2024.
Notice of proposed ordinance was published in the official journal on the 18th day of July, 2024.
Public Hearing on this Ordinance was held on the 12th day of August, 2024 at 6:30pm.
The above and foregoing Ordinance was read and called for a vote by the Mayor at a meeting of the Village Council called for said purpose on the 12th day of August, 2024.
Motion was made by Councilwoman Stacy Weldon and seconded by Councilwoman Mea Dillehay to adopt said Ordinance.
