The Notice of Meeting/Agenda having been duly posted in accordance with requirements, and a quorum being present, the meeting was called to order by Mayor Wayland LaFargue at 6:00 p.m.

Approval of Minutes: Mayor LaFargue asked the council to consider approving the minutes for the regular council meeting of November 4, 2024.
Motion to dispense with the reading of the minutes from November 4, 2024, and approve them as distributed made by: Councilwoman Tunwar, second by Councilwoman Sonnier. Vote: 4-0, passed.
Mayor’s Report: Mayor LaFargue reported that the annual audit was underway and almost complete. He also reported that the Wastewater Treatment Plant project was wrapping up and that the Park Rd. Bridge Project would be starting soon.
Chief of Police Report: Chief Paul Courville presented a detailed report to the council on the police department’s activity for the month of November, including the volume of calls received and reports filed by officers. He also notified council that he had appointed two former full-time police officers to part-time reserve status, Seth Whetstine and Taylor Jackson.
Town Attorney Report: Mr. Holmes asked the council to consider renewing local beer and liquor licenses for 2025. The businesses included in the discussion were: Polos Mexican Restaurant Bar & Grill, Club Hi-Roller, Daiquiri Shack of Kinder, Chadeaux’s, Tobacco Plus, Ted’s Quick Stop, Market Basket, Kinder Quick Stop, Dollar General #3480, Dollar General #24903, The Buzz, Family Dollar, and Just Crawfish. Councilwoman Tunwar proposed handling the renewals in two parts: one motion for all businesses except Polo’s Mexican Restaurant, followed by a separate vote on Polo’s license due to ordinance requirements concerning U.S. citizenship. After some discussion, the following motions were made.
Motion to approve the applications for renewal of beer and liquor licenses for 2025, excluding Polo’s Mexican Restaurant Bar & Grill made by Councilwoman Van Norman, second by Councilwoman Sonnier. Vote: 4-1, passed.

Engineer’s Report: Engineer Tom David began by explaining that the meeting included several condemnation hearings for properties deemed unsafe or uninhabitable. He further informed the council and public that the Town has applied for an LCDBG Clearance Program Grant. If awarded, this grant would cover the costs of demolishing the condemned properties, ensuring that the property owners would not incur any expenses related to the demolition process.
Following this explanation, Tom David proceeded to address each condemnation case individually, opening and closing public hearings, providing details on the condition of each property, and making recommendations for action.

A resolution providing for canvassing the returns and declaring the results of the special election held in the Town of Kinder, State of Louisiana, on Saturday, December 7, 2024, to authorize the extension and rededication of a sales and use tax therein.
BE IT RESOLVED by the Mayor and Council of the Town of Kinder, State of Louisiana (the “Governing Authority”), acting as the governing authority of the Town of Kinder, State of Louisiana (the “Town”), that:
SECTION 1. Canvass. This Governing Authority does now proceed in open and public session to examine the official tabulations of votes cast at the special election held in the Town of Kinder, State of Louisiana, on Saturday, December 7, 2024 (the “Election”), to authorize the extension and rededication of a sales and use tax therein pursuant to the following proposition (the “Proposition”):

(SALES TAX EXTENSION & REDEDICATION)
Shall the Town of Kinder, State of Louisiana (the “Town”), be authorized to continue to levy and collect a 0.3% sales and use tax (the “Tax”) in accordance with Louisiana law (an estimated $205,000 reasonably expected at this time to be collected from the levy of the Tax for an entire year), for a period of 10 years from and after January 1, 2027, with the proceeds of the Tax heretofore or hereafter collected to be used as follows: (i) 90% for the purpose of acquiring, constructing, improving, maintaining and operating the Town’s sanitary sewerage system and (ii) 10% for the purpose of supporting the police department and providing public safety services in the Town?
This Governing Authority does further proceed to examine and canvass the returns of the Election thereof.
SECTION 2. Election Results. According to the official certified tabulation of votes cast at said Election, there was a total of 94 votes cast IN FAVOR OF the Proposition and a total of 24 votes cast AGAINST the Proposition, resulting in a majority of 70 votes cast IN FAVOR OF the Proposition. The Proposition was therefore duly CARRIED by a majority of the votes cast by the qualified electors voting at the Election.
SECTION 3. Promulgation of Election Result. The results of said election shall be promulgated by publication in the manner provided by law, after receipt from the Secretary of State’s office of the actual costs of the election, as required by §18:1292 of the Louisiana Revised Statutes of 1950, as amended.
SECTION 4. Declaration. The foregoing results of the Election are hereby declared by this Governing Authority and shall be published as required by law.
SECTION 5. Procès Verbal. A Procès Verbal of the canvass of the returns of the Election shall be made and a certified copy thereof shall be forwarded to the Secretary of State, Baton Rouge, Louisiana, who shall record the same in her office; another certified copy thereof shall be forwarded to the Clerk of Court and Ex-Officio Recorder of Mortgages in and for the Parish of Allen, who shall record the same in the Mortgage Records of said Parish; and another copy thereof shall be retained in the archives of this Governing Authority.

A resolution providing for canvassing the returns and declaring the results of the special elections held in (i) Road District No. 1 of the Parish of Allen, State of Louisiana, (ii) Sub-Road District No. 1 of Road District No. 1 of the Parish of Allen, State of Louisiana, (iii) Road District No. 3 of the Parish of Allen, State of Louisiana, (iv) Road District No. 4 of the Parish of Allen, State of Louisiana and (v) Sub-Road District No. 5A of the Parish of Allen, State of Louisiana, on Saturday, December 7, 2024, to authorize the levy of special taxes therein.
BE IT RESOLVED by the Police Jury of the Parish of Allen, State of Louisiana (the “Governing Authority”), acting as the governing authority of (i) Road District No. 1 of the Parish of Allen, State of Louisiana, (ii) Sub-Road District No. 1 of Road District No. 1 of the Parish of Allen, State of Louisiana, (iii) Road District No. 3 of the Parish of Allen, State of Louisiana, (iv) Road District No. 4 of the Parish of Allen, State of Louisiana and (v) Sub-Road District No. 5A of the Parish of Allen, State of Louisiana (the “Districts”), that:
SECTION 1. Canvass. This Governing Authority does now proceed in open and public session to examine the official tabulations of votes cast at the special elections held in (i) Road District No. 1 of the Parish of Allen, State of Louisiana, (ii) Sub-Road District No. 1 of Road District No. 1 of the Parish of Allen, State of Louisiana, (iii) Road District No. 3 of the Parish of Allen, State of Louisiana, (iv) Road District No. 4 of the Parish of Allen, State of Louisiana and (v) Sub-Road District No. 5A of the Parish of Allen, State of Louisiana, on Saturday, December 7, 2024 (the “Elections”), to authorize the levy of special taxes therein pursuant to the following propositions (the “Propositions”):

Shall Road District No. 1 of the Parish of Allen, State of Louisiana (the “District”), continue to levy a special tax of 22.03 mills on all property subject to taxation in the District (an estimated $253,000 reasonably expected at this time to be collected from the levy of the tax for an entire year), for a period of 10 years, beginning with the year 2026 and ending with the year 2035, for the purpose of constructing, improving, operating and maintaining Parish roads and bridges within the District?
SUB-ROAD DISTRICT NO. 1 OF ROAD DISTRICT NO. 1

Shall Sub-Road District No. 1 of Road District No. 1 of the Parish of Allen, State of Louisiana (the “District”), continue to levy a special tax of 8.17 mills on all property subject to taxation in the District (an estimated $17,400 reasonably expected at this time to be collected from the levy of the tax for an entire year), for a period of 10 years, beginning with the year 2026 and ending with the year 2035, for the purpose of constructing, operating and maintaining Parish roads and bridges within the District, said millage to represent a .14 mills increase (due to reappraisal) over the 8.03 mills tax authorized to be levied through the year 2025 pursuant to an election held on March 28, 2015?

Shall Road District No. 4 of the Parish of Allen, State of Louisiana (the “District”), continue to levy a special tax of 21.14 mills on all property subject to taxation in the District (an estimated $128,000 reasonably expected at this time to be collected from the levy of the tax for an entire year), for a period of 10 years, beginning with the year 2026 and ending with the year 2035, for the purpose of constructing, improving, operating and maintaining Parish roads and bridges within the District?
SUB-ROAD DISTRICT NO. 5A
OF THE PARISH OF ALLEN, STATE OF LOUISIANA
PROPOSITION (TAX RENEWAL)
Shall Sub-Road District No. 5A of the Parish of Allen, State of Louisiana (the “District”), continue to levy a special tax of 2.79 mills on all property subject to taxation in the District (an estimated $195,600 reasonably expected at this time to be collected from the levy of the tax for an entire year), for a period of 10 years, beginning with the year 2026 and ending with the year 2035, for the purpose of constructing, operating and maintaining Parish roads and bridges within the District?
This Governing Authority does further proceed to examine and canvass the returns of the Elections thereof.
SECTION 2. Election Results. According to the official certified tabulation of votes cast at said Elections, (i) there was a total of 104 votes cast IN FAVOR OF Road District No. 1 Proposition and a total of 44 votes cast AGAINST Road District No. 1 Proposition, resulting in a majority of 60 votes cast IN FAVOR OF Road District No. 1 Proposition;
(ii) there was a total of 35 votes cast IN FAVOR OF Sub-Road District No. 1 of Road District No. 1 Proposition and a total of 12 votes cast AGAINST Sub-Road District No. 1 of Road District No. 1 Proposition, resulting in a majority of 23 votes cast IN FAVOR OF Sub-Road District No. 1 of Road District No. 1 Proposition;
(iii) there was a total of 61 votes cast IN FAVOR OF Road District No. 3 Proposition and a total of 46 votes cast AGAINST Road District No. 3 Proposition, resulting in a majority of 15 votes cast IN FAVOR OF Road District No. 3 Proposition;
(iv) there was a total of 58 votes cast IN FAVOR OF Road District No. 4 Proposition No. 1 and a total of 39 votes cast AGAINST Road District No. 4 Proposition No. 1, resulting in a majority of 19 votes cast IN FAVOR OF Road District No. 4 Proposition No. 1;
(v) there was a total of 62 votes cast IN FAVOR OF Road District No. 4 Proposition No. 2 and a total of 33 votes cast AGAINST Road District No. 4 Proposition No. 2, resulting in a majority of 29 votes cast IN FAVOR OF Road District No. 4 Proposition No. 2; and
(vi) there was a total of 304 votes cast IN FAVOR OF Sub-Road District No. 5A Proposition and a total of 237 votes cast AGAINST Sub-Road District No. 5A Proposition, resulting in a majority of 67 votes cast IN FAVOR OF Sub-Road District No. 5A Proposition.
The Propositions were therefore duly CARRIED by a majority of the votes cast by the qualified electors voting at the Elections.
SECTION 3. Promulgation of Election Result. The results of said elections shall be promulgated by publication in the manner provided by law, after receipt from the Secretary of State’s office of the actual costs of the elections, as required by §18:1292 of the Louisiana Revised Statutes of 1950, as amended.
SECTION 4. Declaration. The foregoing results of the Elections are hereby declared by this Governing Authority and shall be published as required by law.
SECTION 5. Procès Verbal. A Procès Verbal of the canvass of the returns of the Elections shall be made and a certified copy thereof shall be forwarded to the Secretary of State, Baton Rouge, Louisiana, who shall record the same in her office; another certified copy thereof shall be forwarded to the Clerk of Court and Ex-Officio Recorder of Mortgages in and for the Parish of Allen, who shall record the same in the Mortgage Records of said Parish; and another copy thereof shall be retained in the archives of this Governing Authority.
This resolution having been submitted to a vote, the vote thereon was as follows:

The estimated cost of Road District No. 1 election as determined by the Secretary of State based upon the provisions of Chapter 8-A of Title 18 and actual costs of similar elections is $2,400.
The estimated cost of Sub-Road District No. 1 of Road District No. 1election as determined by the Secretary of State based upon the provisions of Chapter 8-A of Title 18 and actual costs of similar elections is $500.
The estimated cost of Road District No. 3 election as determined by the Secretary of State based upon the provisions of Chapter 8-A of Title 18 and actual costs of similar elections is $300.
The estimated cost of Road District No. 4 election as determined by the Secretary of State based upon the provisions of Chapter 8-A of Title 18 and actual costs of similar elections is $1,100.
The estimated cost of Sub-Road District No. 5A election as determined by the Secretary of State based upon the provisions of Chapter 8-A of Title 18 and actual costs of similar elections is $1,900.
Notice is further given that a portion of the monies collected from the taxes described in the Propositions shall be remitted to certain state and statewide retirement systems in the manner required by law.
The said special elections will be held in accordance with the applicable provisions of Chapter 5 and Chapter 6-A of Title 18 of the Louisiana Revised Statutes of 1950, as amended, and other constitutional and statutory authority, and the officers appointed to hold the said elections, as provided in this Notice of Special Elections, or such substitutes therefor as may be selected and designated in accordance with La. R.S. 18:1287, will make due returns thereof to said Governing Authority, and NOTICE IS HEREBY FURTHER GIVEN that the Governing Authority will meet at its regular meeting place, the Police Jury Administration Building, 602 Court Street, Oberlin, Louisiana, on MONDAY, JANUARY 6, 2025, at SIX O’CLOCK (6:00) P.M., and shall then and there in open and public session proceed to examine and canvass the returns and declare the result of the said special elections. All registered voters of the Districts are entitled to vote at said special elections and voting machines will be used.
PROCLAMATION
I, the undersigned President of the Police Jury of the Parish of Allen, State of Louisiana, the governing authority of (i) Road District No. 1 of the Parish of Allen, State of Louisiana, (ii) Sub-Road District No. 1 of Road District No. 1 of the Parish of Allen, State of Louisiana, (iii) Road District No. 3 of the Parish of Allen, State of Louisiana, (iv) Road District No. 4 of the Parish of Allen, State of Louisiana and (v) Sub-Road District No. 5A of the Parish of Allen, State of Louisiana (the “Districts”), do hereby declare, proclaim and announce that the propositions submitted at the special elections held in the Districts on Saturday, December 7, 2024, were CARRIED by a majority of the votes cast at the said special elections, all as described and set out in the above Procès Verbal.
