NOVEMBER 14, 2024
Public Council meeting was held 11/14/24 at 6:30pm at the Elizabeth Village Hall, 230 Poplar Street, Elizabeth, LA. The notice of Meeting having been duly posted in accordance with requirements, the meeting was called to order by Mayor Mandy Green at 6:30pm. Opening prayer led by Mr. Ken Kelly, then Pledge of Allegiance and roll call by Mayor Green.

1. No comments from the public on any agenda item.
2. Ken Kelly made a motion to approve minutes from 10/14/24 meeting. Stacy Weldon seconded. All in favor.

4. ENGINEER’S REPORT
5. Glen Turner, Village engineer gave update on current grants. He stated that the Village will receive the PHMSA Grant funding in the amount of 2.3 million dollars to replace some of the gas system from Elizabeth to Oakdale. He stated the water well project has been completed as of November 13, 2024. All 3 water wells are working now. Mayor Green asked about the substantial completion date of the water well project. Ken Kelly made a motion that November 13, 2024 is the official substantial completion date of the Water Well project. Stacy Weldon seconded. All in favor. Glenn stated that they will make a punch list to complete the water well project. Glenn Turner stated that the contractors of the Sewer Improvement project are waiting for the delivery of some pumps. In reference to the other LDEQ/CWSRF sewer project, the contractor has not begun yet, but the village can collect liquidated damages if the project is not completed on time.
6. CODE COMPLIANCE- Mayor Green stated that some notices had been sent out for property compliance.
7. POLICE CHIEF-Not present.
8. FIRE CHIEF
A. Matt Townson gave monthly report.
B. Update on BBQ Fundraiser- raised over $3000.00. They will be purchasing the Sparky costume. He also stated they will be selling BBQ burgers and funnel cakes at Christmas in the Country.

A. Mea Dillehay made a motion to pass Resolution 125-2024 which allows the Mayor to sign a ROW Agreement with Cleco to upgrade the electrical lines at EHS located on Live Oak Street. Stacy Weldon seconded. All in favor.
B. Mayor Green stated that some of the guys from Cleco would be entering the Gumbo Cookoff at Christmas in the Country.
C. Auditor Royce Scimemi gave the Annual Financial Report for FY 2023-2024. The village received no findings, except segregation of duties due to the village office is so small.
D. Ken Kelly made a motion to accept the Annual Financial Report for FY 2023-2024. Stacy Weldon seconded. All in favor.
E. Ken Kelly made a motion to appoint Auditor Royce Scimemi as the Auditor for FY 2024-2025. Mea Dillehay seconded. All in favor.
10. VILLAGE ATTORNEY
A. Discussed an amendment to Ordinance 48-2024 Proposed 2024-2025 Budget to include funds previously appropriated to the police department to comply of the Local Government Budget Act.
11. COUNCIL
A. Stacy Weldon introduced an Amendment to Ordinance 48-2024 Proposed 2024-2025 Budget to include funds previously appropriated to the police department according to the Local Government Budget Act. Ordinance to become Ordinance 48-2024A. Public hearing prior to adoption on December 9, 2024 at 6:30pm at Village Hall meeting.
B. A public hearing opened on amendment to Ordinance 12-18A Property Maintenance Section 4 to amend prescription period from ten years to three years, amend fee schedule and add definition of equipment. Ordinance to become Ordinance 12-18B. Mayor Green stated the fee schedule would be $80/hr. for heavy equipment and $50/hr. for basic mowing equipment. Heavy equipment to include large heavy-duty machines and basic mowing equipment means mowers, weed eater, chainsaws and edgers. No further comments. Public hearing closed.
C. Ken Kelly made a motion to adopt an amendment to Ordinance 12-18A Property Maintenance Section 4 to amend prescription period from ten years to three years, amend fee schedule and add definition of equipment. Ordinance to become Ordinance 12-18B. Stacy Weldon seconded. Stacy Weldon-yea, Mea Dillehay-yea, Ken Kelly-Yea. Unanimous vote to adopt.
D. Public hearing opened on amendment to Ordinance 06-17E which states that customers requesting to install a gas generator must obtain a $25 permit from the Village office prior to installation and may incur additional associated installation fees to become Ordinance 06-17F. No comments. Public hearing closed.

Ken Kelly made a motion to adopt amendment to Ordinance 06-17E which states that customers requesting to install a gas generator must obtain a $25 permit from the Village office prior to installation and may incur additional associated installation fees to become Ordinance 06-17F. F. Mea Dillehay introduced to abolish Ordinance 10-18A1 which provided for the permitting of prefabricated buildings or other structures. Public hearing prior to adoption on December 9, 2024 at 6:30pm at Village Hall meeting.
G. Stacy Weldon made a motion to adopt Resolution 126-2024 which amends the Village of Elizabeth 457(b) Retirement Plan effective 1-1-2022, to correct an operational failure outlined in the attached amendment, pursuant to the Self-Correction Program authorized under EPCRS Revenue Procedure 2021-30. A RESOLUTION OF THE VILLAGE OF ELIZABETH FOR THE MAYOR TO SIGN A RIGHT OF WAY AGREEMENT WITH CLECO FOR THE ELIZABETH HIGH SCOOL ELECTRICAL LINE UPGRADES ON LIVE OAK STREET
At a regular meeting of the Mayor and Village Council of the Village of Elizabeth, Louisiana, held on November 14, 2024, at which meeting a quorum was present, due notice of same having been made according to law, the following Resolution was made.
WHEREAS, the Village of Elizabeth desires to enter into agreement to allow Cleco Power LLC a perpetual servitude over, under and through a part of a certain tract of land located in Section 20, Township 2 South, Range 4 West, Parish of Allen, Louisiana.
WHEREAS, this resolution states that the village council agrees to allow the Mayor to sign on behalf of the Village of Elizabeth, to enter this agreement with CLECO.
NOW THEREFORE, BE IT RESOLVED THAT THE BOARD OF ALDERMEN OF THE VILLAGE OF ELIZABETH adopts RESOLUTION No. 125-2024 in regular meeting on November 14, 2024.

Resolution 126-2024
TO AMEND QUALIFIED RETIREMENT PLAN
The undersigned, on behalf of Town of Elizabeth (“Employer”), hereby certifies that the following resolutions were duly adopted by the Employer and that such resolutions have not been modified or rescinded as of the signature date below:
WHEREAS, the Employer has maintained the Village of Elizabeth 457(b) Plan (“Plan”) since 1-1-2022, for the benefit of eligible employees.
WHEREAS, the Employer has been duly advised to amend the above-referenced Plan effective 7-1-2022, to correct an operational failure outlined in the attached amendment, pursuant to the Self-Correction Program authorized under EPCRS Revenue Procedure 2021-30.
WHEREAS the Plan document authorizes the Employer to amend the selections under the Adoption Agreement.
NOW, THEREFORE, BE IT RESOLVED that the Plan is amended in accordance with the attached amendment to the Plan, and is hereby approved and adopted and that an authorized representative of the Employer is hereby authorized and directed to execute and deliver to the Administrator of the Plan one or more counterparts of the Plan;
RESOLVED FURTHER, if the Plan amendment modified the provisions of the Summary Plan Description, affected participants will receive a Summary of Material Modifications summarizing the changes under the Plan amendment.

Ordinance No: 06-17F
ORDINANCE SETS UTILITY DEPOSIT AND TAP FEES FOR THE VILLAGE OF ELIZABETH, LOUISIANA UTILITY CUSTOMERS AND TO PROVIDE FOR RELATED MATTERS.
SECTION 1: BE IT ORDAINED, by the Mayor and the Board of Aldermen of Elizabeth, Louisiana in special session convened, that the Board of Alderman and Mayor hereby enacted an amendment to Ordinance 06-17E which allows the Village of Elizabeth to require a permit fee prior to natural gas generators being installed and additional fees for an upgrade. Ordinance to become Ordinance 06-17F and is hereby enacted to read as follows:
SECTION 2: BE IT FURTHER ORDAINED that the water, sewer and gas deposit of the Village of Elizabeth utility system are to be charged before services are connected as shown in section below unless prior arrangements have been approved by Mayor.
CONNECT SERVICES
Residential:
•Water Deposit: $200 plus $25 connect Fee = $225
•Gas Deposit: $225 plus $25 connect Fee = $250
•Water and Gas Deposit = $425 plus $50 connect Fee = $475
Commercial
•Water Deposit: $225 plus $25 connect Fee = $250
•Gas Deposit: $250 plus $25 connect Fee = $275
•Water and Gas Deposit = $475 plus $50 connect Fee = $525
Section 3: BE IT FURTHER ORDAINED that the water, sewer and gas tap fee for the Village of Elizabeth utility system are to be charged before services are connected as shown in section below unless prior arrangements have been approved by Mayor. Prices are for flat ground installation. Large ditches, road bores, excess flow valves and any work or materials outside the normal scope of work can cost extra and is not included in Tap and Deposit Fees.
TAP COST FOR NEW SERVICES
Residential:
•Install Sewer Tap: $375 Fee
•Install Water Tap (3/4” Meter): $175 Fee + ($200 Deposit and $25 Connect Fee) to Total $400
•Install Gas Tap: $250 Fee + ($225 Deposit and $25 Connect Fee) to Total $500
Commercial:
•Install Sewer Tap: $475 Fee
•Install Water Tap (1” Meter): $350 Fee + ($225 Deposit and $25 connect fee) to Total $600
•Install Water Tap (2” Meter or larger) $850 Fee + ($225 Deposit and $25 connect) to Total $1100
•Install Gas Tap: $300 Fee + ($250 Deposit and $25 connect fee) to Total $575
SECTION 4: BE IT ORDAINED that if a customer’s services are disconnected due to nonpayment, they have 30 days from the 10th of the month due date to notify the office that they wish to final bill their utility account or reconnect services. If no payment or notification within 30 days to the Village office, the Village of Elizabeth will final bill the account and apply the deposit on file. Customer will be responsible for balance due after deposit is applied. This amendment effective as of January 10, 2023.
SECTION 5: BE IT ORDAINED that this amendment to ordinance (Section 3) shall become effective August 15, 2023 and if any provision or items of this ordinance or the application thereof is held invalid, such invalidity shall not affect other provisions, items, or application of this ordinance which can be given effect without the invalid provision, items, or application and to this end the provisions of this ordinance are hereby declared severable.
SECTION 6: BE IT ORDAINED that all customers requesting to install a natural gas generator must obtain a $25.00 permit from the Village office prior to installation and may incur additional fees associated with installation.. This amendment will become effective November 15, 2024.
SECTION 7: BE IT ORDAINED that all ordinance or part of ordinance in conflict herewith are hereby repealed.
THIS ORDINANCE was introduced on the 14th day of October, 2024. After Public Hearing having been held on November 14, 2024, title having been read and Ordinance considered, on motion by Councilman Ken Kelly and seconded by Councilwoman Mea Dillehay to adopt said Ordinance 06-17F.

ORDINANCE NUMBER 12-18B
VILLAGE OF ELIZABETH, LOUISIANA
PROPERTY MAINTENANCE AND ENFORCEMENT MEASURES
AN AMENDMENT TO ORDINANCE 12-18A AMENDING PRESCRIPTION PERIOD TO THREE YEARS, AMENDING FEE SCHEDULE, AND ADDING DEFINITION OF EQUIPMENT. TO BECOME ORDINANCE 12-18B, EFFECTIVE NOVEMBER 14, 2024.
BE IT ORDAINED by the Mayor and Board of Aldermen for the Village of Elizabeth, Louisiana, who met in regular session and enacted the following original Ordinance Number 12-18 which shall read as follows:
Section 1: Added Definitions
A. The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:
1. Heavy equipment means large heavy-duty machines including, but not limited to excavators, tractors, dump trailers, bulldozers, backhoe, grader, cranes, loader, scrapers, dump truck.
2. Basic mowing equipment means lawn mowers, weed-eaters, chainsaws and edgers.
Section 2: Enforcement Procedure of Sections 2 and 3- Amended Section
A. Whenever the Mayor has ordered work done to bring property in compliance with Sections 2 or 3, as set forth herein, the sum of $175.00 plus $80.00 per hour or any fraction of an hour per piece of heavy equipment actually used in the work, plus any cost of equipment rented by the Village to perform the work shall be charged and payable by said owner on the date of completion of work. A charge of $175.00 plus $50.00 per hour or any faction of an hour for basic mowing equipment shall be charged and payable by the said owner on the date of completion of work. Accrued interest at the rate of ten percent per annum from the date of completion of the work shall be charged to the owner of the property.
B. Upon completion of such work, the Mayor or the Mayor’s designee shall prepare and file with the recorder of mortgages of the parish a certificate showing the cost of such work along with the fees set out in paragraph (B) of this section, a fee of $275.00 for the cost of preparation and filing of the lien, the name of the owner and a description of the property involved. This certificate shall be recorded by the recorder of mortgages in the mortgage records of this parish and shall operate from the date of filing as a tax lien or assessment of the property affected. This lien shall prescribe only in three years from the date of filing such certificate, may be enforced in a summary manner as other tax liens or assessments, by ordinary proceedings or personally against the property owner as provided for by law, and shall be subject to a ten percent penalty, interest and attorney fees.
Section 3
This ordinance shall become effective upon signature by the Mayor, or in the event of a veto, upon override.
Said amendment to Ordinance having been introduced on the 14th day of October, 2024 by notice of Public Hearing having been published on the 31st day of October, 2024, said Public Hearing having been held, title having been read and Ordinance considered, on motion by Ken Kelly,and seconded by Stacy Weldon to adopt the Ordinance on the 14h day of November, 2024. A record vote was taken, and the following result was had:

Whereupon the Mayor declares the above amendment to Ordinance12-18A to become Ordinance 12-18B duly adopted on the 14th day of November, 2024.
