Notice of Intent to Enter into Settlement of Threatened Litigation
Pursuant to La.Rev.Stat.13:5109(C) Town of Kinder, Louisiana notifies the public that the Town Council of the town has proposed and, ten (10) days after publication of this notice, intends to compromise and settle threatened litigation as follows:
With Coushatta Tribe of Louisiana (CTOL) by executing a document denominated Assignment, Transfer, and Settlement Agreement that will assign and transfer ownership of certain infrastructure situated upon tribal lands in federal trust to the Coushatta Tribe of Louisiana, to wit: a natural gas pipeline valve (commonly known by the parties as “City Gate”) and piping and other associated structures constituting a natural gas distribution system serving Coushatta Casino Resort and associated facilities, and, receiving in exchange and settlement for such assignment and transfer of ownership the sums of (a) $150,000 and (b) $60,000 annually for a period of not less than seven (7) years.

The Department of Homeland Security’s Federal Emergency Management Agency has issued a preliminary Flood Insurance Rate Map (FIRM), and where applicable, Flood Insurance Study (FIS) report, reflecting proposed flood hazard determinations within Allen Parish, Louisiana and Incorporated Areas. These flood hazard determinations may include the addition or modification of Base Flood Elevations, base flood depths, Special Flood Hazard Area boundaries or zone designations, or the regulatory floodway. Technical information or comments are solicited on the proposed flood hazard determinations shown on the preliminary FIRM and/or FIS report for Allen Parish, Louisiana and Incorporated Areas. These flood hazard determinations are the basis for the floodplain management measures that your community is required to either adopt or show evidence of being already in effect in order to qualify or remain qualified for participation in the National Flood Insurance Program. The meeting was called to order by President Logan Hamilton at 6:00 p.m. He led the Board in prayer and Pledge of Allegiance was said by all.
April motioned to accept the previous meeting minutes as read and Katrena seconded the motion. Motion carried.
Adam updated the Board on the Wells. There is no update on Well 3 generator that has been ordered.
Well 4 is completely disassembled and at Griner Drilling shop. They are waiting on replacement parts.
Well 6 maintenance has been halted until Well 4 is repaired and in service.
Adam explained the payment policy that is offered to customers who have experienced a high bill do to leaks/etc…He presented the Board with a policy that moving forward from here on out that customers who need the payment plan will have to come into the office to sign the agreed high bill payment policy. Reggie motioned to accept the high water bill payment policy and April seconded the motion, Motion carried.
The Board reviewed & discussed the Financial Report. Katrena made a motion to accept the Financial Report and pay all bills submitted and Reggie seconded the motion. Motion carried.
Adam reported on the water system. The two old generators sold at Bruchhaus Auctions for a total of $3,522.00. He also stated that we are running the system on Wells 2 and 6. They are running twenty hours a day.
Katrena made a motion to adjourn the meeting at 6:35 p.m. and April seconded the motion. Motion carried.
