WHEREAS, application has been filed in the above captioned succession by Beverly Thomas for permission to list the home for $298,000.00 with permission to sell the home described as Lots Three (3), Four (4) and the South Half (S/2) of Five (5) of Blocks Three (3) East of 10th Street, Kinder, Louisiana Municipal Address: 312 10th Street, Kinder, LA 70648 for a value of not less than a total gross purchase price of $290,000.00 when taking into account any seller concessions for buyer’s incentives or repairs. If no offer is received for at least $290,000.00 after the property is listed on MLS for 45 days, Petitioner requests permission to accept the highest offer, provided it is not less than $275,000.00 when taking into consideration any seller concessions for buyer’s incentives or repairs. Petitioner further requests permission to deduct typical real estate tax prorations, reasonable broker’s fees, and any typical seller’s curative costs (not including the costs of the succession) from Seller’s portion of the sale proceeds with the net proceeds payable 1/2 to Petitioner and 1/2 to the estate of BARRON GRAY THOMAS. Petitioner does further request permission for that portion belonging to the estate be held in the McCain & Swann, LLC IOLTA client trust account and disbursed only upon written agreement of the petitioner as usufructuary and all other heirs as naked owners or upon further order of this court after notice to the heirs and an opportunity to be heard.
Notice is hereby given that all parties to whom it may concern, including the heirs and creditors of the decedent herein, of this estate, be ordered to make any opposition which they have or may have to such application, at any time, prior to the issuance of the Order of Judgment authorizing, approving and homologating such application, and that such Order or Judgment may be issued after the expiration of seven (7) days, from the date of the last publication of this notice, all in accordance with the law.

Separate sealed bids for the TOWN OF OBERLIN, SANITARY SEWER SYSTEM IMPROVEMENTS INFLOW/INFILTRATION REMEDIATION, will be received by the Town of Oberlin at Pan American Engineers, 1717 Jackson Street, Alexandria, Louisiana 71301 until 2:00 P.M. on Wednesday, November 29, 2023, and then at said office publicly opened and read aloud. Any bid received after the specified time and date will not be considered.

The work is generally described as follows: Work includes smoke testing of approximately 100,000 linear feet of sanitary sewer mains, and 322 manholes and television inspection of approximately 100,000 linear feet of sanitary sewer mains, followed by sewer main and manhole rehabilitation to reduce inflow and infiltration.
Copies of the bidding documents shall be obtained from the office of Pan American Engineers, LLC upon deposit of $150.00 for each set of documents; or from the electronic bid submittal option as noted in the Advertisement. The deposit on the first set of documents furnished to bonafide prime bidders will be fully refunded upon return of the documents, in good condition, no later than ten (10) days after receipt of bids. On other sets of documents furnished to bidders, the deposit less actual cost of reproduction will be refunded upon return of the documents, in good condition, no later than ten (10) days after receipt of bids.
The OWNER reserves the right to reject any or all bids for just cause. Such actions will be in accordance with Title 38 of Public Bid Law.
In accordance with L.R.S. 38:2212.B.(1), the provisions and requirements stated in the Bidding Documents shall not be considered as informalities and shall not be waived.
Each Bidder must deposit with the bid, security in the amount of at least five percent (5%) of the total bid price, as described in the Instructions to Bidders. Bid bonds shall be written by a surety or insurance company meeting the requirements noted in L.R.S. 38:2218.
The successful Bidder shall be required to furnish a Performance Bond and Payment Bond, in an amount equal to 100% of the Contract amount, written by a surety or insurance company meeting the requirements noted in L.R.S. 38:2219 A.(1)(a), (b) and (c), or for Federally funded projects, must be listed as acceptable on the U.S. Department of Treasury Circular 570.

APPROVAL OF MINUTES: Mayor LaFargue asked the council to consider approving the minutes for the regular council meeting of September 5, 2023.
Motion to dispense with the reading of the minutes from September 5, 2023, and approve them as distributed made by Councilman Nevils, second by Councilwoman Sonnier. Vote: 3-0, passed.
MAYOR REPORT: Mayor LaFargue gave an update on the Park Rd. bridge replacement project.
ENGINEER REPORT: Wesley Miller asked the council to consider adopting a resolution authorizing the mayor to apply for FY 2024/2025 Louisiana Community Development Block Grant. After some discussion, a motion was made.
Motion to adopt Resolution No. 2023-10 relative to FY 2024/2025 LCDBG application made by Councilman Nevil, second by Councilwoman DeWees. Vote: 3-0, passed.
PUBLIC WORKS REPORT: Eric Fontenot updated the council on several public works projects. He said that the crew continues to locate and repair water leaks mostly caused by drought. He also reported that they recently brought several old vehicles and equipment to auction.
With no further business to discuss, the meeting was adjourned.
