SEPTEMBER 11, 2023
Public Council meeting was held 9/11/23 at 6:30pm at the Elizabeth Community Center, 210 East Main Street, Elizabeth, LA. The notice of Meeting having been duly posted in accordance with requirements, the meeting was called to order by Mayor Green at 6:30pm. Opening prayer led by Glenn Turner, then Pledge of Allegiance and roll call by Mayor Green.

1. Mayor Green asked if any public comment on agenda items. No comments.
2. Stacy Weldon made a motion to approve the 8/14/23 minutes from last meeting. Mea Dillehay seconded. All in favor.
3. ENGINEER’S REPORT- Glenn Turner from MMLH stated that the AB Finke Park project was almost complete. He also reported that the other grants were still in progress.
4. CODE COMPLIANCE- Crystal Hunt stated that she was looking for bids to remove the condemned structure on 1103 Hickory Street. Leo and Hollis Laird (owners) still have not removed the structure.
5. MAYOR’S REPORT
*Old Business
A. Public hearing opened for Ordinance 44-2023 Enforcement of Traffic Violations by Automated Means, Mr. Mike Holmes suggested to amend the ordinance that was presented by adding to the Enforcement Procedures section, that providing the requirement for POST certified officers shall not apply to officers employed directly by the Elizabeth Police Department.
B. Stacy Weldon made a motion to accept amendment to Ordinance 44-2023 as suggested per legal council. Mea Dillehay seconded. All in favor.
C. Mea Dillehay made a motion to adopt Ordinance 44-2023 Enforcement of Traffic Violations by Automated Means with amendment. Stacy Weldon seconded. Mea Dillehay- yea; Stacy Weldon-yea
D. Reminder that bids are being accepted for 307 Cypress Street property. Bids will be accepted until 12 noon on November 13, 2023. Bids to be opened at November 13, 2023 council meeting with a minimum bid of $7000.00. Bids to be marked with 307 Cypress Street Bid on front on envelope along with name and address. Actual Bid must consist of name, address, phone number and email address. The Village of Elizabeth shall reserve the right to reject any and all bids and remove the item of immovable property from sale prior to opening of bids.
E. Update on Elizabeth Clinic was given per Mayor Green. After discussion, Mayor Green and Mr. Holmes will discuss new contract terms. Mea Dillehay made a motion to pass Resolution 92-2023 which authorizes Mr. Holmes and Mayor Green to notify Oakdale Community Hospital of the breech of lease agreement on the Elizabeth Family Health Clinic building and renegotiate new lease under terms to be approved by Board of Aldermen. Stacy Weldon seconded. All in favor.
*New Business
F. Mayor Green stated that Mayor’s Court will now be held every quarter beginning January 1, 2024 until the issue of citations increases. Mayor Green will notify Meredith Guillory the prosecutor for Mayor’s Court.
G. Mea Dillehay made a motion to pass Resolution 91-2023 Authorizing Advertisement for Bids ARPA/WSP Water Well Rehabilitation. Stacy Weldon seconded. All in favor.
6. POLICE CHIEF
A. Chief Ware gave monthly report.
B. Chief Ware made a recommendation to hire a fulltime officer- Katelyn Cotton at the rate of $16.40/hr for 40hours per week. Her start date would be September 25, 2023. He plans to send her to the academy to be POST certified in February 2024. After in depth discussion of what is expected for a full time officer for the village, Stacy Weldon made a motion to approve the chief’s recommendation. Mea Dillehay seconded. All in favor.
7. FIRE CHIEF
A. Asst Chief Self gave monthly report.
B. Also discussed was a request from the Chief to lease for purchase radios for the fire department personnel and some to be issued during emergency storms and such to the Mayor and Police Chief. The council suggested to allow them time to look over the proposal and call a special meeting by September 25, 2023 to approve.
8. COUNCIL
A. Introduce amendment to increase sewer rates Ordinance 14-18F Utility Rates to become Ordinance 14-18G
9. Stacy Weldon made a motion for Council to approve expenses for August and comparison of actual expenses to budget. Mea Dillehay seconded. All in favor.
10. Mea Dillehay motioned to adjourn. Stacy Weldon seconded. All in favor.

ORDINANCE 44-2023
AN ORDINANCE amending the Village of Elizabeth code of ordinances to provide for the enforcement of certain traffic violation by automated means and provides for civil penalties for certain traffic violations enforced by automated means, and otherwise providing with respect thereto
At a regular meeting held the 13th day of September, 2023 by the Mayor and Aldermen of the Village of Elizabeth the said governing body considered Ordinance 44-2023.
Be it further resolved, that if any provision of this Ordinance or the application thereof is held invalid, such invalidity shall not affect other provisions, items or application of this Ordinance which can be given effect without the invalid provisions, items or application and it this end the provisions of this Ordinance are hereby declared severable.
Now therefore, be it ORDAINED that this ordinance having been submitted in writing and then submitted to final vote as a whole and the vote thereon being as followed:
Public Hearing on this Ordinance was held on the 11th day of September, 2023 at 6:30 P.M. at the Community Center located at 210 East Main Street, Elizabeth, Louisiana.
The above and foregoing Ordinance was read and called for a vote by the Mayor at a meeting of the Village Aldermen called for said purpose on the 11th day of September, 2023. Motion was made by Alderwoman Mea Dillehay and seconded by Alderwoman Stacy Weldon to adopt said ordinance.

ARPA/WSP WATER WELL REHABILITATION

RESOLUTION 91-2023
At a Meeting of the Mayor and Board of Aldermen of the Village of Elizabeth, Louisiana, held on Monday, September 11, 2023, at which meeting a quorum was present, due notice of same having been made according to law, the following Resolution was made:
WHEREAS, the Village of Elizabeth desires to improve its drinking water production facilities; and
WHEREAS, the Village of Elizabeth has received $207,600 in grant funding from the Louisiana Water Sector Program and has committed up to $54,014 of its grant funding from the American Rescue Plan Act with sufficient funds to cover the Engineer’s cost estimate;
NOW THEREFORE BE IT RESOLVED that the Mayor is hereby authorized, on behalf of the Village, to perform the following:
1. Assist the State of Louisiana in performing a water rate study as a condition of receiving the Water Sector Program funds and provide the information required by the firm assigned by the Office of Community Development – Local Government Assistance to complete the study; and
2. Publicly advertise for bids the Water Well Rehabilitation upon funding agency approval.
This Resolution being submitted to a vote, the vote thereon was as follows:

RESOLUTION NO. 92-2023
A Resolution Authorizing the Mayor and City Attorney to notify Oakdale Community Hospital of breach of lease agreement on Elizabeth Family Health Clinic building and to renegotiate new lease under terms to be approved by Board of Aldermen
WHEREFORE, the Board of Alderman, considering the history of failure to comply with the terms of the lease document between Village of Elizabeth and Oakdale Community Hospital for the building commonly known as Elizabeth Family Health Clinic, and upon advice of legal counsel, and finding the action reasonable and necessary;
NOW, THEREFORE, BE IT RESOLVED, by the Board of Aldermen of the Village of Elizabeth, Louisiana, acting as the governing authority of Village of Elizabeth, State of Louisiana do hereby authorize the Mayor and City Attorney to notify Oakdale Community Hospital of breach of said lease agreement and to renegotiate a new lease under terms to be approved by the Board of Aldermen.

NW ALLEN PARISH WATERWORKS DISTRICT
MEETING
September 11, 2023
The regular meeting of the NW Allen Parish Waterworks District was called to order at 5:30pm, on Monday, September 11, 2023 at the Water District Office by Don Dowies. A prayer was given by Glenn Turner.
Present: Don Dowies, Shirley Stanton, Josh Thompson, Dustin Kisting, and Penny Johnson
Guests: Glenn Turner, and Brad Rachel of Meyers, Meyers, Lecroix, & Hixon
Operator’s Report: Dustin Kisting updated the Board on the #2 booster motor that was picked up today. He is also taking the #2 booster pump to Kelly’s Tool Company to get it reworked.
He updated the Board on the 3 leaks that he has repaired. He still has 2 small leaks left.
He put in 10 new radio-read meters. Two required bores. He still has a bore and meter to put in on Hwy 26 after the DOTD permit is approved.
He discussed a problem with one of the new radio-read master meters. The warranty is to be checked, and discussed with Lafayette Winwater.
He discussed the problem with our generator that occurred after the electricity failure last Friday, September 8, 2023. The warranty is to be checked. Arcco is coming to fix the generator this Thursday, September 14, 2023.
New Business: The Board discussed Dustin Kisting taking a 32-hour class, and tests the week of October 16-20, 2023. Shirley Stanton made a motion to send Dustin to the training, to take the test, and pay for him to stay in a motel the night before the tests. Joshua Thompson seconded. All agreed.
Old Business: Glenn Turner presented the new engineer, Brad Rachel, that will be the engineer for our Water Filter’s Project. He updated the Board on the progress of the loan application.
The Office Manager updated the Board on the progress with Servline Leak Protection. They will provide training on September 20, 2023. They will also mail their brochure and a letter from us, to all our customers at the end of this month.
The money from our approved 2021-2022 CWEF Grant of $26,772.00 was released. The Office Manager ordered 100 radio-read meters.
Office Manager Report: There were 575 active customers during the month of August.
The August ending bank balance for the Operating Account was $22,185.68
Several customer issues were discussed.

Early Notice and Public Review of a Proposed
Activity in a 100-Year Floodplain and Wetland
This is to give notice that the Village of Elizabeth has determined that the following proposed action under the Village’s 2022 LCDBG Public Facilities Program is located in the wetlands, and the Village will be identifying and evaluating practicable alternatives to locating the action in the wetlands and the potential impacts on the wetlands from the proposed action, as required by Executive Order 11988 and 11990, in accordance with HUD regulations at 24 CFR 55.20 Subpart C Procedures for Making Determinations on Wetland Management.
The funding will address deficiencies in the Village’s waste water treatment plant. The project includes replacing pumps and controls at the In-Plant Lift Station as well as the School and Eastern Heights Lift Stations, and upgrading Little Piney Park Lift Station.
There are three primary purposes for this notice. First, people who may be affected by activities in wetlands those who have an interest in the protection of the natural environment should be given an opportunity to express their concerns and provide information about these areas. Second, an adequate public notice program can be an important public educational tool. The dissemination of information about wetlands can facilitate and enhance Federal efforts to reduce the risks associated with the occupancy and modification of these special areas. Third, as a matter of fairness, when the Federal government determines it will participate in actions taking place in wetlands, it must inform those who may be put at greater or continued risk.

SECTION 2. Publication of Notice of Special Election. Pursuant to La. R.S. 18:1285, a Notice of Special Election concerning the Election will be published in the Oakdale Journal, a newspaper of general circulation within the District, and is the official journal of the District, once a week for four (4) consecutive weeks, with the first publication to be made not less than forty-five (45) days nor more than ninety (90) days prior to the date fixed for the Election, which notice will be substantially in accordance with the Notice of Special Election annexed hereto as Exhibit A and incorporated herein by reference, to the same extent as if it were set forth in full.
Canvass of Election Returns. This Governing Authority will meet on Monday, April 8, 2024 at 5:00 p.m. at the Allen Parish School Board Office, 1111 West 7th Avenue, Oberlin, Louisiana, and will then and there in open and public session proceed to examine and canvass the official election returns and declare the results of the said Election, pursuant to Section 1292 of Title 18 of the Louisiana Revised Statutes of 1950, as amended.

Furnishing Election Call. In accordance with La. R.S. 18:1285(B)(1), certified copies of this Resolution will be forwarded promptly to the Secretary of State, the Clerk of Court and Ex-Officio Custodian of Voting Machines in and for the Parish of Allen, and the Registrar of Voters in and for said Parish, as notification of the call for the Election in order that each may prepare for said Election and perform their respective functions as required by law.
SECTION 5. Estimated Collections. Pursuant to La. R.S. 18:1284(c), an estimated $672,879.00 is reasonably anticipated at this time to be collected from the levy of the Tax for an entire year.
Application to State Bond Commission. Application be and the same is hereby formally made to the State Bond Commission for consent and authorization to hold a special proposition election in the District, as previously specified herein, said Election to be held within the District on SATURDAY, MARCH 23, 2024, and in the event the aforesaid proposition is carried for consent and authorization to levy and collect the Tax provided for by said proposition in the amount, for the purpose and for the number of years herein specified; and that a certified copy of this Resolution will be forwarded to the State Bond Commission on behalf of the Governing Authority, together with a letter requesting the prompt consideration and approval of such application.
SECTION 6. Additional Notice Requirement. This Governing Authority made the announcement with respect to this Resolution required by La. R.S. 42:19.1, at its public meeting on Monday, August 14, 2023 and published said announcement in the Official Journal on Thursday, August 17, 2023. Such announcement was also transmitted via email to State Senators and Representatives on Thursday, August 17, 2023.

BE IT RESOLVED by the Governing Authority, that:

SECTION 2. Publication of Notice of Special Election. Pursuant to La. R.S. 18:1285, a Notice of Special Election concerning the Election will be published in the Oakdale Journal, a newspaper of general circulation within the District, and is the official journal of the District, once a week for four (4) consecutive weeks, with the first publication to be made not less than forty-five (45) days nor more than ninety (90) days prior to the date fixed for the Election, which notice will be substantially in accordance with the Notice of Special Election annexed hereto as Exhibit A and incorporated herein by reference, to the same extent as if it were set forth in full.
Canvass of Election Returns. This Governing Authority will meet on Monday, April 8, 2024 at 5:00 p.m. at the Allen Parish School Board Office, 1111 West 7th Avenue, Oberlin, Louisiana, and will then and there in open and public session proceed to examine and canvass the official election returns and declare the results of the said Election, pursuant to Section 1292 of Title 18 of the Louisiana Revised Statutes of 1950, as amended.
SECTION 3. Polling Places; Commissioners. The polling places set forth in the attached Notice of Special Election, and situated within the corporate limits of the District, be and the same are hereby designated as the polling places at which the Election will be held. Pursuant to the provisions of La. R.S. 18:1286(B), the Commissioners-in-Charge and the Commissioners authorized to be selected by the Board of Election Supervisors to serve at the Election on SATURDAY, MARCH 23, 2024, are hereby designated as the Commissioners-in-Charge and Commissioners to serve at the polling places designated for this Election.
Designation of Commissioners and Commissioners-in-Charge. As required in La. R.S. 18:1286(B), the officers designated to serve as Commissioners-in-Charge and Commissioners pursuant to Section 4 hereof, will hold the Election as herein provided solely in compliance with the provisions of Parts II and V of the Election Code, as amended, and will make due returns of said Election in accordance with the aforesaid provisions of the Election Code. The compensation of said officers be and the same is hereby fixed at the sum prescribed by law. SECTION 4. Authorization of Secretary. The Secretary of the Governing Authority, be and hereby is empowered, authorized and directed to arrange for and to furnish the election officers, in ample time for the holding of said Election, all equipment, forms and other items which may be required in order to hold said Election. The Secretary of the Governing Authority is further authorized, empowered and directed to take any and all further action required by State and/or Federal law to arrange for the Election.
Furnishing Election Call. In accordance with La. R.S. 18:1285(B)(1), certified copies of this Resolution will be forwarded promptly to the Secretary of State, the Clerk of Court and Ex-Officio Custodian of Voting Machines in and for the Parish of Allen, and the Registrar of Voters in and for said Parish, as notification of the call for the Election in order that each may prepare for said Election and perform their respective functions as required by law.
SECTION 5. Estimated Collections. Pursuant to La. R.S. 18:1284(c), an estimated $169,067.00 is reasonably anticipated at this time to be collected from the levy of the Tax for an entire year.
Application to State Bond Commission. Application be and the same is hereby formally made to the State Bond Commission for consent and authorization to hold a special proposition election in the District, as previously specified herein, said Election to be held within the District on SATURDAY, MARCH 23, 2024, and in the event the aforesaid proposition is carried for consent and authorization to levy and collect the Tax provided for by said proposition in the amount, for the purpose and for the number of years herein specified; and that a certified copy of this Resolution will be forwarded to the State Bond Commission on behalf of the Governing Authority, together with a letter requesting the prompt consideration and approval of such application.
SECTION 6. Additional Notice Requirement. This Governing Authority made the announcement with respect to this Resolution required by La. R.S. 42:19.1, at its public meeting on Monday, August 14, 2023 and published said announcement in the Official Journal on Thursday, August 17, 2023. Such announcement was also transmitted via email to State Senators and Representatives on Thursday, August 17, 2023.

Pursuant to the provisions of a Resolution adopted on September 11, 2023, by the Parish School Board of the Parish of Allen, State of Louisiana (the “Governing Authority”), acting as the governing authority of School District Ward One of Allen Parish, State of Louisiana (the “District”), NOTICE IS HEREBY GIVEN that a special election will be held in the District on SATURDAY, MARCH 23, 2024, and that at said election there will be submitted to all registered voters of the District, qualified in and entitled to vote at said election under the Constitution of the State of Louisiana of 1974, as amended, and the Constitution of the United States and by other constitutional and statutory authority supplemental thereto, the following proposition, to wit:

Shall School District Ward One of the Parish of Allen, State of Louisiana (the “District”), be authorized to continue to levy a special tax of five and seventy-three hundredths (5.730) mills on all the property subject to taxation within the District (an estimated $63,515.00 reasonably expected at this time to be collected from the levy of the tax for an entire year), for a period of ten (10) years, beginning with the year 2026 and ending with the year 2035, for the purpose of constructing, improving, operating and maintaining school facilities in and for the District, said millage to represent a three hundredths of a mill (.03) decrease over the 5.76 mills tax authorized to be levied through the year 2025 pursuant to an election held on April 9, 2016?
The special election will be held in at the following polling places situated in the District, and which polls will open at 7:00 a.m. and close at 8:00 p.m. on SATURDAY, MARCH 23, 2024, in compliance with the provisions of Section 541 of Title 18 of the Louisiana Revised Statutes of 1950, as amended (La. R.S. 18:541). The Commissioners-in-Charge and the Commissioners authorized to be selected by the Parish Board of Election Supervisors at the special election on SATURDAY, MARCH 23, 2024, are hereby designated as the Commissioners-in-Charge and the Commissioners to serve at the following described polling places designated for this election, to-wit:

The polling places set forth above and situated in the District, be and the same are hereby designated as the polling places at which to hold the special election, and the Commissioners-in-Charge and Commissioners, respectively, shall be those persons designated according to law.
A portion of the monies collected from the Tax shall be remitted to certain state and statewide retirement systems in accordance with the provisions of Subtitle 1 of Title 11 of Louisiana Revised Statutes of 1950, as amended (La. R.S. 11:82).
In accordance with La. R.S. 18:1285(A)(1)(a)(v), the estimated cost of holding the election will be $15,000.00.
The special election will be held in accordance with the applicable provisions of Chapter 5 and Chapter 6-A of Title 18 of the Louisiana Revised Statutes of 1950, as amended, and other constitutional and statutory authority as applicable thereto, and the officers appointed to hold the election, or such substitutes therefor as may be selected and designated in compliance with law, will make due returns thereof to the District, and NOTICE IS HEREBY FURTHER GIVEN that the Governing Authority will meet on Monday, April 8, 2024, at 5:00 p.m. at the Allen Parish School Board Office, 1111 West 7th Avenue, Oberlin, Louisiana, and will then and there, in open and public session, proceed to examine and canvass the returns and declare the result of the special election. All registered voters residing in the District are entitled to vote at the special election and voting machines will be used in connection therewith.

I, the undersigned Secretary of the Parish School Board of the Parish of Allen, State of Louisiana (the “Governing Authority”), acting as the governing authority of School District Ward One of Allen Parish, State of Louisiana, do hereby certify that the foregoing constitutes a true and correct copy of a Resolution adopted by the Governing Authority on September 11, 2023, ordering and calling a special election to be held in School District Ward One of Allen Parish, State of Louisiana (the “District”) on Saturday, March 23, 2024, for the purpose of authorizing the continuation of a 5.730 mills tax on assessed valuation of all property subject to taxation in the District, for a period of ten (10) years for the purpose of constructing, improving, operating and maintaining school facilities in and for the District; and further making application to the State Bond Commission for consent and authorization to hold the aforesaid election; and further providing for other matters in connection therewith.
I further certify that this Resolution has not been amended or rescinded.
