Pursuant to the provisions of a resolution adopted by the Police Jury of the Parish of Allen, State of Louisiana (the “Governing Authority”), acting as the governing authority of (i) Road District No. 1 of the Parish of Allen, State of Louisiana, (ii) Sub-Road District No. 1 of Road District No. 1 of the Parish of Allen, State of Louisiana, (iii) Road District No. 3 of the Parish of Allen, State of Louisiana, (iv) Road District No. 4 of the Parish of Allen, State of Louisiana and (v) Sub-Road District No. 5A of the Parish of Allen, State of Louisiana (the “Districts”), on August 5, 2024, NOTICE IS HEREBY GIVEN that special elections will be held within the Districts on SATURDAY, DECEMBER 7, 2024, and that at the said elections there will be submitted to all registered voters in the Districts qualified and entitled to vote at the said elections under the Constitution and Laws of the State of Louisiana and the Constitution of the United States, the following propositions, to-wit:

The polling places at the precincts in the Districts are hereby designated as the polling places at which to hold the said elections, and the Commissioners-in-Charge and Commissioners, respectively, shall be those persons designated according to law.
The estimated cost of Road District No. 1 election as determined by the Secretary of State based upon the provisions of Chapter 8-A of Title 18 and actual costs of similar elections is $2,400.
The estimated cost of Sub-Road District No. 1 of Road District No. 1 election as determined by the Secretary of State based upon the provisions of Chapter 8-A of Title 18 and actual costs of similar elections is $500.
The estimated cost of Road District No. 3 election as determined by the Secretary of State based upon the provisions of Chapter 8-A of Title 18 and actual costs of similar elections is $300.
The estimated cost of Road District No. 4 election as determined by the Secretary of State based upon the provisions of Chapter 8-A of Title 18 and actual costs of similar elections is $1,100.
The estimated cost of Sub-Road District No. 5A election as determined by the Secretary of State based upon the provisions of Chapter 8-A of Title 18 and actual costs of similar elections is $1,900.
Notice is further given that a portion of the monies collected from the taxes described in the Propositions shall be remitted to certain state and statewide retirement systems in the manner required by law.
The said special elections will be held in accordance with the applicable provisions of Chapter 5 and Chapter 6-A of Title 18 of the Louisiana Revised Statutes of 1950, as amended, and other constitutional and statutory authority, and the officers appointed to hold the said elections, as provided in this Notice of Special Elections, or such substitutes therefor as may be selected and designated in accordance with La. R.S. 18:1287, will make due returns thereof to said Governing Authority, and NOTICE IS HEREBY FURTHER GIVEN that the Governing Authority will meet at its regular meeting place, the Police Jury Administration Building, 602 Court Street, Oberlin, Louisiana, on MONDAY, JANUARY 6, 2025, at SIX O’CLOCK (6:00) P.M., and shall then and there in open and public session proceed to examine and canvass the returns and declare the result of the said special elections. The Allen Parish Police Jury met in regular session at the Police Jury Administration Building, Oberlin, Louisiana, September 3, 2024 at the hour of 6:00pm.

Motion seconded and carried to go into session.
The Lord’s Prayer was said followed by the Pledge of Allegiance.
Motion seconded and carried to approve minutes of the meeting held August 5, 2024.
The Finance Committee had the following recommendations:
1) Approve to pay Butler Tree Service $3,950.00 for trimming and maintenance of trees at the Courthouse.
2) Approve to pay Movable Buildings $2,500.00 to move a building from the Allen Outreach to the LSU Ag Center.
Motion seconded and carried to accept the recommendations of the Finance Committee.
The Road Committee had the following recommendations:
1) Approve a JSA with the City of Oakdale for grass cutting, pothole patching and trash pick-up for the month of September, 2024.

In accordance with federal laws and regulation, the Kinder Housing Authority is revising its Public Housing Admissions and Continued Occupancy Policy (ACCOP). The proposed date of implementation is December 1, 2024, for the Housing Opportunity Through Modernization ACT (HOTMA) revisions, which will be implement in January 1, 2025, or later depending upon receipt of the applicable software updates per PIH Notice 2023-27.
The current ACOP Admin Plan and the proposed revisions to the Public Housing ACOP are available for review and comment from Thursday October 10 to Friday October 11, 2024 at the Kinder Housing Authority Administration Office located at 514 1/2 17th St., Kinder, La.
Written comments on the proposed revisions must be addressed to Sylvia Manuel, Director, PO Box 808, Kinder, La 70648 and must be received by the close of business (3:00p.m.) on October 11, 2024.

Request for Scenic River Permit on Barnes Creek
The Secretary of the Louisiana Department of Wildlife and Fisheries (LDWF) as Administrator of the Louisiana Natural and Scenic Rivers System is currently considering the application of Texas Eastern Transmission, LP for a permit to evaluate and repair a section of its existing Line 18 pipeline on Barnes Creek in Allen Parish. The decision to grant or deny this permit in the public interest will be based on an evaluation of the probable impacts of the proposed activity on Barnes Creek.
Copies of the application can be reviewed by the public at the LDWF main office, 2000 Quail Drive, Room 432, Baton Rouge, LA and at the District Office nearest the proposed activity. The application can also be viewed on the LDWF website at www.wlf.louisiana.gov/scenic-rivers. The public is invited to comment on this permit request for a period of forty-five (45) days. Ryan Daigle requested the board enter an executive session to discuss personnel.
A motion was made to allow a representative of Expert Bookkeeping and Royce Scimemi’s office to stay while the board went into an executive session.
Larry Victorian made a motion to end the executive session. None were opposed.
Vallard Carrier made a motion to adjourn the meeting at 6:01 PM he was seconded by Larry Victorian.

Robby Evans made a motion to accept the Fire Chief’s resignation at the end of the month, he was seconded by Karen Morrow.
The Public Comment period was opened to the general public, at this time various members of the community spoke on the agenda items.

Pursuant to the provisions of a resolution adopted by the Mayor and Council of the Town of Kinder, State of Louisiana (the “Governing Authority”), acting as the governing authority of the Town of Kinder, State of Louisiana (the “Town”), on September 9, 2024, NOTICE IS HEREBY GIVEN that a special election will be held within the Town on SATURDAY, DECEMBER 7, 2024, and that at the said election there will be submitted to all registered voters in the Town qualified and entitled to vote at the said election under the Constitution and Laws of the State of Louisiana and the Constitution of the United States, the following proposition, to-wit:

Shall the Town of Kinder, State of Louisiana (the “Town”), be authorized to continue to levy and collect a 0.3% sales and use tax (the “Tax”) in accordance with Louisiana law (an estimated $205,000 reasonably expected at this time to be collected from the levy of the Tax for an entire year), for a period of 10 years from and after January 1, 2027, with the proceeds of the Tax heretofore or hereafter collected to be used as follows: (i) 90% for the purpose of acquiring, constructing, improving, maintaining and operating the Town’s sanitary sewerage system and (ii) 10% for the purpose of supporting the police department and providing public safety services in the Town?

APPROVAL OF MINUTES: Mayor LaFargue asked the council to consider approving the minutes for the regular council meeting of August 5, 2024.
Motion to dispense with the reading of the minutes from August 5, 2024, and approve them as distributed made by Councilman Nevils, second by Councilwoman Sonnier. Vote: 5-0, passed.
MAYOR REPORT: Mayor LaFargue gave an update on several projects that are ongoing. He also recognized Barbara Savant, Executive Director of the Kinder Chamber of Commerce and Jacob Dillehay, Allen Parish Police Jury who were both at the meeting to address the council. Mrs. Savant reported on several upcoming events in Kinder and reminded citizens to shop locally. Mr. Dillehay gave an update on the Park Rd. bridge project.
CHIEF OF POLICE REPORT: Chief Paul Courville gave a report on the calls and reports for the month of August.
TOWN ATTORNEY REPORT: Mr. Holmes asked council to consider adopting Resolution No. 2024-09 ordering and calling a special election to authorize the extension and rededication of a .3% sales and use tax. After some discussion, a motion was made.
Motion to adopt Resolution No. 2024-09 ordering and calling a special election to authorize the extension and rededication of a .3% sales and use tax made by Councilman Nevils, second by Councilwoman DeWees.
Mayor LaFargue called for a roll call vote:

Mr. Holmes opened a public hearing regarding Ordinance No. 884 relative to the compensation of the Town Clerk. There being no public comment, the public hearing was closed.
Motion to adopt Ordinance No. 884, setting the compensation for the Town Clerk at $56,709 per year effective October 1, 2024 made by Councilwoman Van Norman, second by Councilwoman Sonnier.

Mr. Holmes also asked the council to consider a resolution authorizing the mayor to enter into a joint service agreement allowing the Town of Kinder to participate in the Allen Parish Police Jury’s stand-by debris hauling and monitoring contracts if necessary, during future natural disasters. After some discussion, a motion was made.
Motion to adopt Resolution 2024-10 made by Councilwoman Van Norman, second by Councilman Nevils. Vote: 5-0, passed.
ENGINEER REPORT: C.W. Roland, Pan American Engineers, reported on the progress of the ongoing wastewater treatment plant project and the Louisiana Watershed Initiative grant project for improved drainage in the Nixon Addition. He also said that he and Eric Fontenot talked about looking into grants that could be used to upgrade the Town’s gas system.
PUBLIC WORKS REPORT: Eric Fontenot reported on water leaks, culvert washouts and other maintenance issues that the public works crew has been working on throughout town.
TOWN CLERK REPORT: Traci Fontenot thanked the mayor and town council for approving a pay increase. She also reported that income statements with monthly budget-to-actual comparisons are included with the mayor and council meeting packets.
